Privacy Notice

What personal data ElNotaryo collects, why we use it, who receives it, how long we keep it, and how to use your privacy rights.

Effective date:

1. Who we are

ElNotaryo operates this platform and decides how the personal data described here is used. The legal name and address of the operator, and the contact details of our Data Protection Officer, are pending confirmation and will be published here. Until then, send privacy questions and requests to support@elnotaryo.com.

2. Personal data we collect

  • Account details: your name, email address, mobile number and password. We store only a protected form of your password, never the password itself.
  • Profile details: your address and, if you give it, your nationality.
  • Identity verification results: the type of ID used, the last four characters of its number, whether your name, liveness and face checks passed, a face match score, and for remote sessions the general area of your location and whether a VPN was detected.
  • Request details: the documents you upload, the service you choose, the signatories you add and their contact details and addresses, your appointment, messages with the ENP, and the notarized document.
  • Notarial records: the entry the ENP makes in their electronic notarial book for a completed act.
  • Security and usage records: sign-ins, important actions and the IP address they came from, kept in our audit log.

3. Why we use your data

  • To create and run your account and your notarization requests.
  • To verify the identity of each signatory before and during a session, with your consent.
  • To let the ENP review your request, hold the session and keep the records the notarial rules require.
  • To send you notices about your requests and account by email and in the app.
  • To keep the platform secure, prevent fraud and investigate misuse.

We rely on your consent, on what we need to provide the service you ask for, on our legal obligations and on our legitimate interest in keeping the platform secure. The lawful basis for each purpose is pending privacy review and will be listed here.

4. Who receives your data

  • The ENP you choose, who sees your request, documents and identity verification result.
  • Other signatories on the same request, who see only what they need to take part.
  • Service providers that help us run the platform, such as identity verification, video sessions, email delivery and hosting. The names of these providers are pending confirmation.
  • Courts, regulators or other authorities when the law requires it.

5. Cookies and sessions

We use cookies that the platform needs to work: one keeps you signed in, one protects forms from forged submissions, and one remembers a device you chose to trust for 30 days. We don't use advertising cookies.

6. Transfers outside the Philippines

Where our service providers store or process data is pending confirmation. If any personal data is processed outside the Philippines, we will say so here and describe how it is protected.

7. How we protect your data

  • Connections to ElNotaryo are encrypted.
  • Sign-in needs your password and an emailed code, unless you trusted the device.
  • Staff and ENPs can see only the records their role allows, and important actions are recorded in an audit log.
  • Uploaded and notarized documents are kept in private storage and checked when uploaded.

8. How long we keep your data

  • Abandoned drafts and cancelled requests are deleted after a set period. We tell you before a draft is removed.
  • Completed notarizations are official notarial records and are kept as the notarial rules require. They are not deleted when you close your account.
  • A legal hold keeps records that are needed for a legal matter until the hold is released.
  • A copy of your data that you download is deleted 7 days after it is ready.

The exact retention periods are pending confirmation and will be listed here.

9. Your rights

Under the Data Privacy Act of 2012 you can ask to be informed about, access, correct, object to, or delete your personal data, and to receive a copy of it.

  • Get a copy: use Download My Data in the Privacy section of your profile. We email you a secure link, which expires after 7 days. You can ask for a new copy once every 24 hours.
  • Correct: update your contact details in your profile. To correct details that came from identity verification, contact us.
  • Close your account: use Delete Account in the Privacy section once you have no requests in progress. Official notarial records are kept.
  • Anything else: email support@elnotaryo.com. We may ask you to confirm who you are first.

10. Complaints

If you are concerned about how we handle your personal data, contact us first so we can try to resolve it. You can also complain to the National Privacy Commission.

11. Changes to this notice

We will post any new version of this notice here with a new "Last updated" date. Read the Data Privacy Act Compliance page for how we approach Philippine data privacy.
